style="font-size: 16px;">实践中，生产经营项目、场所发包或者出租的情况比较普遍，有些生产经营单位安全管理工作混乱，存在“以包代管”“以租代管”的问题，不主动核查承租方是否具备相应的资质，对承包单位、承租单位的安全生产不闻不问，导致事故隐患大量存在，类似生产安全事故时有发生。为此，《安全生产法》对生产经营项目、场所发包或者出租行为作出了专门的规定：</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">首先，生产经营单位要与承包单位、承租单位签订专门的安全生产管理协议，或者在承包合同、租赁合同中约定各自的安全生产管理职责。这种专门协议或者专项条款，对于明确生产经营单位与承包单位、承租单位各自的安全生产管理职责，促使其加强安全生产管理，具有重要意义。同时，也是发生生产安全事故后判断各方责任的重要依据。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">其次，无论安全生产管理职责如何划分，作为发包单位、出租单位的生产经营单位，对承包单位、承租单位的安全生产工作应当统一协调、管理。这是其法定义务，不得通过安全生产管理协议或者承包合同、租赁合同免除或者转嫁给承包单位、承租单位。在协议中转嫁义务的，相关条款无效。</span></p><p style="text-indent: 2em;line-height: 2em;"><span style="font-size: 16px;">最后，生产经营单位应定期对承包单位、承租单位进行安全检查，发现安全问题的，应当及时督促整改。这一规定既进一步明确了发包单位、出租单位的责任，避免“以包代管”“包而不管”问题的发生，同时也为其进行安全生产检查以及督促承包单位、承租单位整改安全生产问题提供了法律依据。<br></span></p></section></section><section
